Care sunt actele normative relevante?<br \/>\nOrdonan\u0163a Guvernului nr. 137\/2000 privind prevenirea \u015fi sanc\u0163ionarea tuturor formelor de discriminare este legea general\u0103 care reglementeaz\u0103 h\u0103r\u0163uirea moral\u0103, \u00een timp ce Legea nr. 202\/2002 privind egalitatea de \u015fanse \u015fi de tratament \u00eentre femei \u015fi b\u0103rba\u0163i reglementeaz\u0103 h\u0103r\u0163uirea psihologic\u0103, aceasta din urm\u0103 av\u00e2nd ca scop eliminarea tuturor formelor de discriminare bazat\u0103 pe criteriul sexului, \u00een toate sferele vie\u0163ii publice din Rom\u00e2nia.<br \/>\n2. Ce \u00eenseamn\u0103 h\u0103r\u0163uire moral\u0103 \u015fi h\u0103r\u0163uire psihologic\u0103?<br \/>\nH\u0103r\u0163uirea moral\u0103 reprezint\u0103 orice comportament exercitat cu privire la un angajat de c\u0103tre un alt angajat care este superiorul s\u0103u ierarhic, de c\u0103tre un subaltern \u015fi\/sau de c\u0103tre un angajat comparabil din punct de vedere ierarhic, \u00een leg\u0103tur\u0103 cu raporturile de munc\u0103, care s\u0103 aib\u0103 drept scop sau efect o deteriorare a condi\u0163iilor de munc\u0103 prin lezarea drepturilor sau demnit\u0103\u0163ii angajatului, prin afectarea s\u0103n\u0103t\u0103\u0163ii sale fizice sau mentale ori prin compromiterea viitorului profesional al acestuia, comportament manifestat \u00een oricare dintre urm\u0103toarele forme:<br \/>\n\uf0a7 conduit\u0103 ostil\u0103 sau nedorit\u0103;<br \/>\n\uf0a7 comentarii verbale;<br \/>\n\uf0a7 ac\u0163iuni sau gesturi.<br \/>\nH\u0103r\u0163uirea psihologic\u0103 reprezint\u0103 orice comportament necorespunz\u0103tor care are loc \u00eentr-o perioad\u0103, este repetitiv sau sistematic \u015fi implic\u0103 un comportament fizic, limbaj oral sau scris, gesturi sau alte acte inten\u0163ionate \u015fi care ar putea afecta personalitatea, demnitatea sau integritatea fizic\u0103 ori psihologic\u0103 a unei persoane.<br \/>\n3. Prin ce se deosebesc cele dou\u0103 no\u0163iuni?<br \/>\nSpre deosebire de h\u0103r\u0163uirea moral\u0103, cea psihologic\u0103 poate fi sanc\u0163ionat\u0103 \u015fi \u00een afara rela\u0163iilor de munc\u0103,&nbsp; dac\u0103 se \u00eencalc\u0103 egalitatea de \u015fanse \u015fi de tratament \u00eentre femei \u015fi b\u0103rba\u0163i, Legea nr. 202\/2002 privind egalitatea de \u015fanse \u015fi de tratament \u00eentre femei \u015fi b\u0103rba\u0163i fiind o reglementare special\u0103, determinat\u0103 de anumite categorii de situa\u0163ii.<br \/>\nCu toate acestea, h\u0103r\u0163uirea psihologic\u0103 \u00ee\u015fi gase\u015fte \u00eencadrarea, de multe ori,&nbsp;&nbsp; \u00een r\u00e2ndurile celor angaja\u0163i, prin ceea ce se nume\u015fte mobbing. Mobbingul este o form\u0103 de h\u0103r\u0163uire psihologic\u0103, care se manifest\u0103 mai ales pe fondul unui raport de munc\u0103 \u015fi care presupune o serie de ac\u0163iuni sau inac\u0163iuni repetate ale unui grup, \u00eendreptate sistematic, de regul\u0103, asupra unei singure persoane. Mobbing-ul, ca form\u0103 a h\u0103r\u0163uirii psihologice, presupune comportamente subtile, aparent normale, care pot duce \u00eens\u0103 la discreditarea persoanei \u00een cauz\u0103.<br \/>\nH\u0103r\u0163uirea moral\u0103, la locul de munc\u0103 este cea care se aplic\u0103 exclusiv \u00een domeniul raporturilor de munc\u0103. \u00cen cazul h\u0103r\u0163uirii morale, inten\u0163ia de a prejudicia prin acte, sau fapte de h\u0103r\u0163uire moral\u0103 la locul de munc\u0103 nu trebuie s\u0103 fie dovedit\u0103.<br \/>\n\u00cen cazul h\u0103r\u0163uirii psihologice inten\u0163ia trebuie demonstrat\u0103 pentru c\u0103 \u00een acest caz legiuitorul se refer\u0103, \u00een mod concret, la acte inten\u0163ionate. Dac\u0103 exist\u0103 o pl\u00e2ngere privitoare la mobbing, angajatul trebuie s\u0103 fac\u0103 dovada c\u0103 exist\u0103 elemente constitutive ale h\u0103r\u0163uirii psihologice, iar angajatorul trebuie s\u0103 demonstreze \u00een mod obiectiv c\u0103 atitudinea care face obiectul pl\u00e2ngerii nu constituie mobbing.<br \/>\n4. Prin ce se aseam\u0103n\u0103 cele dou\u0103 no\u0163iuni?<\/p>\n<p>Se poate conchide faptul c\u0103 cele dou\u0103 no\u0163iunii au \u00een vedere pe de-o parte, valori identice care necesit\u0103 a fi protejate, respectiv demnitatea, integritatea fizic\u0103 \u015fi mental\u0103, personalitatea care poate fi afectat\u0103 de stres sau epuizare fizic\u0103, iar, pe de alt\u0103 parte, comportamente \u00een cauz\u0103 care se fundamenteaz\u0103 pe atitudini fizice, limbaj oral sau scris.<br \/>\nMai mult dec\u00e2t at\u00e2t,&nbsp; atunci c\u00e2nd ambele&nbsp; no\u0163iuni se \u00eent\u00e2lnesc pe t\u0103r\u00e2mul dreptului muncii, angajatorii sunt obliga\u0163i \u00een temeiul normelor \u015fi principiilor contractuale s\u0103-l desp\u0103gubeasc\u0103 pe salariat, \u00een situa\u0163ia \u00een care acesta a suferit un prejudiciu material sau moral, din culpa angajatorului.<\/p>\n<p>\n<a href=\"https:\/\/www.mediafax.ro\/social\/tu-stii-ce-reprezinta-hartuirea-morala-dar-hartuirea-psihologica-te-ai-confruntat-cu-stres-si-epuizare-fizica-21724176\">Cititi mai multe pe www.mediafax.ro<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Te-ai confruntat cu stres \u015fi epuizare fizic\u0103? 1.
