Raportul din noiembrie 2018 a subliniat faptul c\u0103 \u201emodul de func\u0163ionare a serviciilor de informa\u0163ii nu \u0163ine de competen\u0163a UE \u015fi nu intr\u0103 \u00een sfera obiectivelor referin\u0163\u0103 ale MCV. Instan\u0163ele sunt cele care au rolul de a stabili dac\u0103 alega\u0163iile \u00een cauz\u0103 privind abuzurile sunt \u00eentemeiate sau nu \u015fi dac\u0103 ar fi necesar\u0103 o anchet\u0103 deschis\u0103 \u015fi impar\u0163ial\u0103 pentru a se stabili dac\u0103 au existat sau nu deficien\u0163e sistemice, ca de exemplu str\u00e2ngerea ilegal\u0103 de probe sau exercitarea unei influen\u0163e ilegale asupra magistra\u0163ilor, \u015fi dac\u0103 garan\u0163iile juridice existente trebuie s\u0103 fie consolidate.\u201d, <strong><a href=\"https:\/\/www.mediafax.ro\/politic\/raport-mcv-privind-sistemul-judiciar-romania-slabirea-notabila-rolului-sectiei-procurori-favoarea-judecatorilor-csm-sectia-speciala-instrument-presiune-politica-recomandarile-expertilor-europeni-18489268\" target=\"_blank\"><span style=\"color:#ff0000;\">se arat\u0103 \u00een raportul MCV.<\/span><\/a><\/strong><\/p>\n<p>\nDocumentul men\u0163ioneaz\u0103 c\u0103 principala evolu\u0163ie din 2019, relevant\u0103 pentru raportul MCV, este decizia Cur\u0163ii Constitu\u0163ionale privind cele dou\u0103 protocoale de cooperare semnate \u00eentre Ministerul Public \u015fi SRI \u00een 2009 \u015fi 2016.<\/p>\n<p>\n&#8220;Pe scurt, \u00een ceea ce prive\u015fte protocolul semnat \u00een 2016 de c\u0103tre Ministerul Public \u015fi SRI, Curtea Constitu\u0163ional\u0103 a hot\u0103r\u00e2t c\u0103 protocolul respectiv este legal. Ordonan\u0163a de urgen\u0163\u0103 nr. 6\/2016 de modificare a Codului de procedur\u0103 penal\u0103 a impus un protocol de cooperare pentru a stabili modul de colaborare \u00eentre servicii. \u00cen ceea ce prive\u015fte protocolul din 2009, Curtea Constitu\u0163ional\u0103 a hot\u0103r\u00e2t c\u0103 protocolul a dep\u0103\u015fit rolul constitu\u0163ional al Ministerului Public \u015fi c\u0103, pentru toate cauzele viitoare \u015fi pendinte, instan\u0163ele, \u00eempreun\u0103 cu parchetele, ar trebui s\u0103 verifice dac\u0103 probele colectate \u00een contextul protocolului au fost administrate cu respectarea deplin\u0103 a legii \u015fi s\u0103 decid\u0103 cu privire la m\u0103surile juridice corespunz\u0103toare. Decizia nu se aplic\u0103 hot\u0103r\u00e2rilor judec\u0103tore\u015fti care au devenit definitive \u00eenainte de pronun\u0163area deciziei CCR. Este \u00eenc\u0103 devreme pentru a determina pe deplin impactul \u015fi consecin\u0163ele punerii \u00een aplicare concrete a acestei decizii, \u00een special \u00een ceea ce prive\u015fte lupta \u00eempotriva corup\u0163iei&#8221;, se arat\u0103 \u00een raport.<\/p>\n<p>\nTotodat\u0103, reprezentan\u0163ii CE precizeaz\u0103 c\u0103 \u00cenalta Curte de Casa\u0163ie \u015fi Justi\u0163ie va avea un rol crucial \u00een asigurarea consecven\u0163ei jurispruden\u0163ei.<\/p>\n<p>\nCurtea Constitu\u0163ional\u0103 a Rom\u00e2niei a ar\u0103tat, \u00een motivarea ce vizez\u0103 \u00eencheierea protocoalelor secrete dintre Ministerul Public \u015fi SRI, c\u0103 acestea sunt \u00een afara ordinii constitu\u0163ionale \u015fi au obligat legiuitorul s\u0103 lupte contra unei paradigme juridice neconstitu\u0163ionale de peste 9 ani.<\/p>\n<p>\nCCR precizeaz\u0103 c\u0103, analiz\u00e2nd con\u0163inutul lor celor dou\u0103 protocoale, respectiv Protocolul nr.00750 din 4 februarie 2009 \u015fi Protocolul nr.09472 din 8 decembrie 2016, se constat\u0103 c\u0103 obiectivele ce au vizat, \u00een principal, \u201dplanurile comune de ac\u0163iune\u201d \u015fi \u201dechipele operative comune\u201d stabilite prin primul Protocol [art.3 lit.g)], \u00een condi\u0163iile \u00een care acest articol nu se prevede doar la cooperarea \u00een vederea prevenirii amenin\u0163\u0103rilor securit\u0103\u0163ii na\u0163ionale, ci vizeaz\u0103 \u015fi combaterea \u201dinfrac\u0163iunilor grave\u201d, dep\u0103\u015fesc cadrul legal, \u00een condi\u0163iile \u00een care SRI nu are calitatea de organ de urm\u0103rire penal\u0103 \u015fi, prin urmare, nici competen\u0163\u0103 \u00een acest domeniu.<\/p>\n<p>\nCCR a admis,\u00een 16 ianuarie 2019, sesizarea Camerei Deputa\u0163ilor referitoare la existen\u0163a unui conflict \u00eentre Parlament \u015fi Ministerul Public care prevede, printre altele, c\u0103 efectele protocoalelor continu\u0103 s\u0103 se produc\u0103, chiar \u015fi dup\u0103 denun\u0163area lor.<\/p>\n<p>\nMCV a fost instituit \u00een 2007, \u00een momentul ader\u0103rii Rom\u00e2niei la Uniunea European\u0103, ca m\u0103sur\u0103 menit\u0103 s\u0103 faciliteze eforturile sus\u0163inute ale Rom\u00e2niei \u00een reforma sistemului judiciar \u015fi al intensific\u0103rii luptei \u00eempotriva corup\u0163iei. MCV a fost angajament comun al statului rom\u00e2n \u015fi al UE \u00een acest sens.
