Aceste prevederi \u201eoblig\u0103 \u00een mod nerealist \u015fi intempestiv to\u0163i angajatorii din Rom\u00e2nia s\u0103 ini\u0163ieze negocieri colective pe parcursul a doar 30 de zile calendaristice pentru transferul contribu\u0163iilor sociale \u015fi de s\u0103n\u0103tate de la angajator la angajat, \u00een ciuda faptului c\u0103 efectele transferului acestor contribu\u0163ii nu au fost clarificate\u201d<\/em>, men\u0163ioneaz\u0103 confedera\u0163ia patronal\u0103, \u00eentr-un comunicat.<\/p>\n<p>\n<em>\u201eConsider\u0103m c\u0103 prin m\u0103surile men\u0163ionate se are \u00een vedere de fapt un transfer incorect \u015fi for\u0163at de responsabilitate c\u0103tre angajatori \u015fi sindicate pentru deciziile asumate unilateral de Guvernul Rom\u00e2niei prin OUG nr. 79\/2017, care produc efecte negative, at\u00e2t asupra angajatorilor, c\u00e2t \u015fi asupra angaja\u0163ilor \u00eentr-o perioad\u0103 \u00een care nici unii, nici ceilal\u0163i, nu pot anticipa magnitudinea acestor decizii\u201d<\/em>, mai arat\u0103 CONCORDIA.<\/p>\n<p>\nConfedera\u0163ia patronal\u0103 atrage aten\u0163ia c\u0103 \u00een aceste condi\u0163ii \u201ese creeaz\u0103 premisele unor multiple conflicte colective de munc\u0103, cu consecin\u0163e greu de anticipat, put\u00e2ndu-se ajunge \u015fi la blocarea unor sectoare de activitate sau chiar a economiei \u00een ansamblu\u201d.<\/p>\n<p>\nArgumentele invocate de angajatori sunt urm\u0103toarele:<br \/>\n&#8211; Actul normativ con\u0163ine articolul VII asupra c\u0103ruia nu a existat niciun fel de consultare prealabil\u0103 a partenerilor sociali. Acest articol nu a fost inclus \u00een proiectul transmis c\u0103tre institu\u0163iile avizatoare, cu at\u00e2t mai pu\u0163in c\u0103tre Consiliul Economic si Social (CES);<br \/>\n&#8211; Proiectul transmis incomplet spre avizare c\u0103tre CES a primit aviz negativ;<br \/>\n&#8211; Noua form\u0103 a proiectului nu este \u00eenso\u0163it\u0103 de avizul de oportunitate emis de Ministerul pentru Rela\u0163ia cu Parlamentul \u015fi nici de avizul Ministerului Justi\u0163iei, Consiliul Legislativ a avizat proiectul OUG cu observa\u0163ii \u015fi propuneri, subliniind inclusiv nerespectarea prevederilor constitu\u0163ionale;<br \/>\n&#8211; A\u015fa cum a sesizat \u015fi Consiliul Legislativ, textul de la art. VII este imprecis formulat, gener\u00e2nd probleme de interpretare \u015fi aplicare, ceea ce conduce la \u00eenc\u0103lcarea principiului privitor la calitatea \u015fi claritatea legii, exigen\u0163\u0103 impus\u0103 \u00een mod constant de Curtea Constitu\u0163ional\u0103.<\/p>\n<p>\n<em>\u201e\u00cen condi\u0163iile unei lipse totale de transparen\u0163\u0103 \u00een adoptarea unor m\u0103suri care nu sunt fundamentate pe un dialog social real \u015fi pe un studiu de impact (necesare conform prevederilor Legii nr. 24\/2000 privind tehnica legislativ\u0103)\u201d, membrii CP CONCORDIA consider\u0103 c\u0103 astfel de m\u0103suri \u201edestabilizeaz\u0103 suplimentar dialogul social \u015fi intensific\u0103 o situa\u0163ie de incertitudine \u015fi lips\u0103 de predictibilitate \u00een raporturile de munc\u0103 \u015fi \u00een dezvoltarea mediului de afaceri\u201d.<\/em><\/p>\n<p>\n\u0162in\u00e2nd cont de multitudinea de probleme eviden\u0163iate mai sus, determinate de punerea \u00een aplicare a OUG nr. 82\/2017, c\u00e2t \u015fi de problemele de fond ce decurg din implementarea dispozi\u0163iilor OUG nr. 79\/2017 referitoare la transferul contribu\u0163iilor de la angajator la angajat, CP CONCORDIA solicit\u0103 renun\u0163area la noul sistem impus unilateral prin cele dou\u0103 reglement\u0103ri sau, cel pu\u0163in, prorogarea termenului de aplicare a acestora pentru a permite realizarea unui studiu de impact \u015fi desf\u0103\u015furarea unui proces real \u015fi efectiv de consultare.<\/p>\n<p>\nCONCORDIA este confedera\u0163ia patronal\u0103 care reune\u015fte cele mai puternice federa\u0163ii sectoriale din economia rom\u00e2neasc\u0103 \u015fi cuprinde 7 din primele 10 companii dup\u0103 num\u0103rul de angaja\u0163i \u015fi cifra de afaceri. Concordia \u00ee\u015fi asum\u0103 misiunea reprezent\u0103rii echidistante a intereselor membrilor s\u0103i, companii cu capital rom\u00e2nesc \u015fi str\u0103in, av\u00e2nd o perspectiv\u0103 divers\u0103 \u015fi relevant\u0103 asupra realit\u0103\u0163ilor economice \u015fi sociale.
