Acest act poate fi solicitat angajatorului sau, dac\u0103 acesta nu poate ori nu vrea s\u0103 \u00eel elibereze, direct inspectoratelor teritoriale de munc\u0103. De asemenea, din 28 noiembrie 2016, at\u00e2t angajatorii, c\u00e2t \u015fi institu\u0163iile \u015fi autorit\u0103\u0163ile publice sunt obligate s\u0103 elibereze, la \u00eencetarea activit\u0103\u0163ii persoanelor pe care le-au pl\u0103tit, o adeverin\u0163\u0103 de vechime.<\/div>\n<div class=\"articleTeaser\">\n<p>\nC\u0103r\u0163ile de munc\u0103 nu se mai \u00eentocmesc \u015fi completeaz\u0103 \u00eencep\u00e2nd din 1 ianuarie 2011, dat\u0103 de la care eviden\u0163a muncii se realizeaz\u0103 doar electronic, prin intermediul registrului general de eviden\u0163\u0103 a salaria\u0163ilor (ReviSal), reglementat prin Hot\u0103r\u00e2rea de Guvern nr. 500\/2011. Conform acestui act normativ, fiecare angajator are obliga\u0163ia de a \u00eenfiin\u0163a \u015fi transmite la inspectoratul teritorial de munc\u0103 un registru general de eviden\u0163\u0103 a salaria\u0163ilor \u015fi de a-l prezenta inspectorilor de munc\u0103, la solicitarea acestora.<\/p>\n<p>\nDispari\u0163ia carnetelor de munc\u0103 a f\u0103cut c\u0103 dovada vechimii \u00een munc\u0103 s\u0103 se poat\u0103 face numai cu ajutorul unor adeverin\u0163e care s\u0103 precizeze perioadele lucrate de salaria\u0163ii angaja\u0163i cu contract de munc\u0103.<\/p>\n<h2>\nCum se ob\u0163ine adeverin\u0163a de vechime \u00een munc\u0103?<\/h2>\n<p>\nExist\u0103 mai multe situa\u0163ii care trebuie luate \u00een calcul.<\/p>\n<p>\n<strong>1. Atunci c\u00e2nd salariatul solicit\u0103 angajatorului o astfel de adeverin\u0163\u0103.<\/strong><\/p>\n<p>\nPotrivit art. 5 din HG. 500\/2011, angajatorul este obligat s\u0103 emit\u0103 adeverin\u0163a, \u00een original sau copie certificat\u0103, \u00een maxim 15 zile de c\u00e2nd a fost solicitat\u0103.<\/p>\n<p>\n<em>\u201cLa solicitarea salariatului sau a unui fost salariat, angajatorul este obligat s\u0103 elibereze un document care s\u0103 ateste activitatea desf\u0103\u015furat\u0103 de acesta, durata activit\u0103\u0163ii, salariul, vechimea \u00een munc\u0103, \u00een meserie \u015fi \u00een specialitate.\u201d art. 5, HG nr. 500\/2011<\/em><\/p>\n<p>\nObliga\u0163ia angajatorului, prev\u0103zut\u0103 \u00een HG 500\/2011, este dublat\u0103 \u015fi de o prevedere a Codului Muncii care, la art. 34, precizeaz\u0103 c\u0103: &#8220;l<em>a solicitarea salariatului sau a unui fost salariat, angajatorul este obligat s\u0103 elibereze un document care s\u0103 ateste activitatea desf\u0103\u015furat\u0103 de acesta, durata activit\u0103\u0163ii, salariul, vechimea \u00een munc\u0103, \u00een meserie \u015fi \u00een specialitate<\/em>&#8220;.<\/p>\n<p>\n<strong>2. Atunci c\u00e2nd angajatorul nu vrea sau nu poate elibera o adeverina de vechime \u00een munc\u0103.<\/strong><\/p>\n<p>\n\u00cen acest caz, tot HG 500\/2011 reglementeaz\u0103 situa\u0163ia \u015fi prevede c\u0103 salaria\u0163ii au posibilitatea s\u0103 solicite documentul direct la Inspectoratul Teritoril de Munc\u0103 din raz\u0103 c\u0103ruia angajatorul \u00ee\u015fi desf\u0103\u015foar\u0103 activitatea. Textul legal spune c\u0103 &#8220;Inspectoratul teritorial de munc\u0103 elibereaz\u0103 documentul, \u00een baza registrului electronic transmis de angajator, \u00een termen de cel mult 15 zile de la dat\u0103 solicit\u0103rii&#8221;.<\/p>\n<p>\nServiciul nu este, \u00eens\u0103, gratuit, eliberarea adeverin\u0163ei fiind taxat\u0103 cu 20 de lei\/document, potrivit Ordinul Ministerului Muncii nr. 826\/2014, actul normativ care reglementeaz\u0103 tarifele \u015fi taxele percepute de ITM.<\/p>\n<p>\nTrebuie s\u0103 \u015fti\u0163i c\u0103, \u00een cazul \u00een care angajatorul refuz\u0103, neav\u00e2nd motive obiective, s\u0103 elibereze adeverin\u0163ele de vechime \u015fi orice alte documente calitatea de salariat a solicitantului, el poate fi amendat cu o minim 300 de lei, amend\u0103 care poate ajunge \u015fi la 1.000 de lei.<\/p>\n<p>\nTot ce trebuie s\u0103 face\u0163i este s\u0103 sesiza\u0163i ITM, singura institu\u0163ie abilitat\u0103 s\u0103 constate aceast\u0103 contraven\u0163ie \u015fi s\u0103 aplice amenzile corespunz\u0103toare.<\/p>\n<p>\n<a href=\"http:\/\/www.avocatnet.ro\/content\/articles\/id_44558\/Adeverinta-de-vechime-in-munca-2017-singurul-act-cu-care-poti-dovedi-cat-ai-lucrat-Cum-il-obtii.html\">Cititi mai multe pe www.avocatnet.ro<\/a><\/p>\n<\/div>\n<p>\n&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Sunt deja 6 ani de c\u00e2nd nu se mai emit carnete de munc\u0103, iar salaria\u0163ii au un singur document care s\u0103 ateste c\u00e2t au lucrat: adeverin\u0163a de vechime \u00een munc\u0103.
