{"id":127761,"date":"2015-10-02T10:35:03","date_gmt":"2015-10-02T10:35:03","guid":{"rendered":"https:\/\/bm.dev.synology.me\/?p=127761"},"modified":"2015-10-02T10:35:03","modified_gmt":"2015-10-02T10:35:03","slug":"curtea-de-justitie-a-ue-cetatenii-uniunii-trebuie-informati-despre-transmiterea-si-prelucrarea-datelor-personale","status":"publish","type":"post","link":"https:\/\/bm.dev.synology.me\/?p=127761","title":{"rendered":"Curtea de Justi\u0163ie a UE: Cet\u0103\u0163enii Uniunii trebuie informa\u0163i despre transmiterea \u015fi prelucrarea datelor personale"},"content":{"rendered":"<p>\n<strong>Curtea de Justi\u0163ie a Uniunii Europene (CJUE) a luat aceast\u0103 hot\u0103r\u00e2re joi, dup\u0103 ce a fost sesizat\u0103 de Curtea de Apel Cluj, \u00een dosarul Smarandei Bara \u015fi altor cet\u0103\u0163eni rom\u00e2ni \u015fi al Casei Na\u0163ionale de Asigur\u0103ri de S\u0103n\u0103tate.<\/strong><\/p>\n<p>\nInstan\u0163a din Rom\u00e2nia a solicitat Cur\u0163ii de Justi\u0163ie s\u0103 stabileasc\u0103 dac\u0103 dreptul Uniunii se opune ca o autoritate a administra\u0163iei publice a unui stat membru s\u0103 transmit\u0103 date cu caracter personal unei alte autorit\u0103\u0163i a administra\u0163iei publice, \u00een vederea prelucr\u0103rii lor ulterioare, f\u0103r\u0103 ca persoanele vizate s\u0103 fi fost informate despre aceast\u0103 transmitere \u015fi despre aceast\u0103 prelucrare.<\/p>\n<p>\nConform unui comunicat al CJUE, Smaranda Bara \u015fi mul\u0163i al\u0163i cet\u0103\u0163eni rom\u00e2ni desf\u0103\u015foar\u0103 activit\u0103\u0163i independente, iar administra\u0163ia fiscal\u0103 rom\u00e2n\u0103 a transmis datele privind veniturile lor declarate c\u0103tre Casa Na\u0163ionale de Asigur\u0103ri de S\u0103n\u0103tate, care a solicitat \u00een consecin\u0163\u0103 plata restan\u0163elor contribu\u0163iilor la sistemul de asigur\u0103ri de s\u0103n\u0103tate.<\/p>\n<p>\nPersoanele vizate au contestat la Curtea de Apel Cluj legalitatea acestui transfer \u00een raport cu prevederile directivei privind prelucrarea datelor cu caracter personal care reglementeaz\u0103 prelucrarea acestora \u00een cazul \u00een care sunt con\u0163inute sau urmeaz\u0103 s\u0103 fie con\u0163inute \u00eentr-un sistem de eviden\u0163\u0103 a datelor cu caracter personal. Reclaman\u0163ii au considerat c\u0103 datele lor au fost utilizate \u00een alte scopuri dec\u00e2t cele pentru care au fost comunicate ini\u0163ial administra\u0163iei fiscale, f\u0103r\u0103 a fi informa\u0163i \u00een prealabil.<\/p>\n<p>\n<strong>&#8220;Dreptul rom\u00e2n abiliteaz\u0103 entit\u0103\u0163ile publice s\u0103 transmit\u0103 date cu caracter personal caselor de asigur\u0103ri de s\u0103n\u0103tate pentru a le permite acestora din urm\u0103 s\u0103 stabileasc\u0103 calitatea de asigurat a persoanelor vizate. Datele respective privesc identificarea persoanelor (nume, prenume, adres\u0103), \u00eens\u0103 nu cuprind date privind veniturile ob\u0163inute&#8221;, conform sursei citate.<\/strong><\/p>\n<p>\n\u00cen hot\u0103r\u00e2rea de joi, Curtea consider\u0103 c\u0103 &#8220;cerin\u0163a prelucr\u0103rii corecte a datelor personale oblig\u0103 o autoritate a administra\u0163iei publice s\u0103 informeze persoanele vizate despre transmiterea acestor date unei alte autorit\u0103\u0163i a administra\u0163iei publice \u00een vederea prelucr\u0103rii lor de c\u0103tre aceasta din urm\u0103 \u00een calitate de destinatar al datelor men\u0163ionate. Directiva impune expres ca orice eventual\u0103 limitare a obliga\u0163iei de informare s\u0103 fie adoptat\u0103 prin m\u0103suri legislative&#8221;.<\/p>\n<p>\nCurtea subliniaz\u0103 c\u0103 legea rom\u00e2n\u0103 care prevede transmiterea gratuit\u0103 a datelor personale c\u0103tre casele de asigur\u0103ri de s\u0103n\u0103tate nu constituie o informare prealabil\u0103 care s\u0103 permit\u0103 scutirea operatorului de obliga\u0163ia de a informa persoanele de la care colecteaz\u0103 datele. Astfel, legea \u00een cauz\u0103 nu define\u015fte nici informa\u0163iile transmisibile, nici modalit\u0103\u0163ile de efectuare a transmiterii, acestea figur\u00e2nd numai \u00eentr-un protocol bilateral \u00eencheiat \u00eentre administra\u0163ia fiscal\u0103 \u015fi casa de asigur\u0103ri de s\u0103n\u0103tate.<\/p>\n<p>\n<strong>&#8220;\u00cen ceea ce prive\u015fte prelucrarea ulterioar\u0103 a datelor transmise, directiva prevede c\u0103 operatorul care prelucreaz\u0103 date trebuie s\u0103 comunice persoanelor vizate informa\u0163ii cu privire la propria identitate, la scopul prelucr\u0103rii, precum \u015fi orice alte informa\u0163ii suplimentare necesare pentru a asigura o prelucrare corect\u0103 a datelor.
